If you have been injured in a drunk driving accident or lost someone you love, Kentucky's dram shop law may provide justice

The dangers of drunk driving are well known. It is estimated that 29 people die everyday in the United States as a result of drunk driving. Unfortunately, Kentucky is all too familiar with this tragedy. From the Carrollton bus crash to the recent loss of the Abbas family on their way home to Michigan, these horrible accidents represent fatalities that are entirely preventable.

Kentucky law does provide some relief to those either injured by a drunk driver or to their loved ones. Kentucky's "dram shop" law, holds establishments such as restaurants and bars liable to victims of drunk driving when it can be proved the business over served a patron. If the person who sold or served the alcohol did so knowing the patron was already intoxicated, or had reason to think he was intoxicated, the business can be held liable to the drunk's innocent victims once he leaves the bar.

Kentucky's "dram shop" laws can be complex and have certain substantive and procedural requirements that must be met in order to preserve the claim against the business who over served the drunk driver. It is important that the claims be handled by an experienced Kentucky dram shop lawyer so evidence can be preserved, and the case proceed according to the law.
